Touch necessary?

Do we have canon evidence to suggest that James Martin has to touch in order to sample a persons DNA, to make the copy. I realize there were multiple examples of him making physical contact with his intended identity, but I do not recall seeing him touch Sylar at all before he shifted into Sylar. Discrepency? Bad Editing? Thoughts?
